Terms of Service

These Terms of Service (“Terms”) are an agreement between you and Simple, LLC, an Arizona limited liability company (“we”, “us”), governing your use of Starter Kit Sample (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility and accounts

You must be able to form a binding contract and be at least 13 years old (or the minimum age in your country). You can sign in with an emailed link or with Google. You are responsible for your account and for activity under it. Tell us promptly at legal@simplellc.com if you believe your account was used without your permission.

2. Your content

You keep ownership of what you put into the Service. You grant us only the limited license needed to host, store, transmit, back up, and display it to operate the Service for you. We do not sell your content.

3. Acceptable use

• Do not break the law or infringe anyone’s rights using the Service.
• Do not upload malware, attempt to breach security, or disrupt the Service.
• Do not access other users’ data.
• Do not reverse engineer or resell the Service, except where that restriction is prohibited by law.

4. Purchases and billing

Payments are processed by Stripe. We never receive or store your full card details. Except where required by law, payments are non-refundable. We may change prices on prospective notice; changes never affect a purchase you have already made.

5. Our intellectual property

The Service, including its software, design, and the Starter Kit Sample name, is owned by Simple, LLC and its licensors. These Terms grant you no rights to it beyond using the Service as permitted here.

6. Termination

You may stop using the Service at any time. We may suspend or end your access if you materially violate these Terms, if the law requires it, or to protect the Service or other users. Sections that by their nature should survive termination survive it.

7. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

8. Limitation of liability

To the maximum extent permitted by law, Simple, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim arose, or US $100. Nothing in these Terms limits liability that cannot be limited by law.

9. Changes to these Terms

We may update these Terms. We will revise the “Last updated” date above and, for material changes, give additional notice. Continued use after changes take effect means you accept them.

10. Governing law

These Terms are governed by the laws of the State of Arizona, United States, without regard to its conflict-of-laws rules. You and Simple, LLC agree that the state and federal courts located in Arizona have exclusive jurisdiction over any dispute arising from these Terms or the Service, except that either party may seek injunctive relief in any court of competent jurisdiction. If you are a consumer, this does not deprive you of the protection of mandatory consumer law where you live.
